  1. These terms and conditions relate to all matters pertaining to access and use of the www.eFunctionalSafety.com website and secure site efs.litmos.com, resources and related materials, hereinafter known as "eFunctionalSafety", "eFS", "Us" and "We". eFunctionalSafety® is a registered trademark and trading name of FIABLE Limited whose registered company address is Unit 1 Eliot Business Park, Goldsmith Way, Nuneaton, England, CV10 7RJ. All resources and materials made available through the access or use of eFS are the property of FIABLE Limited by whom all local and international rights are owned and reserved.
  2. Any person or organisation accessing or using eFS by way of a paid-for or temporary trial account is hereinafter known as "Subscriber" or "You". By agreeing to these terms and conditions You confirm that You are authorized to act in this way for the organisation You represent, to the extent that the organisation You represent is liable for any breach of these Terms and Conditions.
  3. Accepting these Terms and Conditions constitutes the Contract between FIABLE Limited and You.
  4. You agree not to breach the rights, in any way, relating to the resources made available by and through eFS.
  5. You acknowledge and agree that copyright and all other intellectual property rights in the Goods, documents and materials associated with the Goods shall remain vested in Us, and You will not acquire any title, copyright or other proprietary rights in such Goods, documentation or materials.
  6. You understand that material presented in good faith by eFS is intended to promote best known practice, and that it is the responsibility of the Subscriber to make its own judgement as to the use of any material presented.
  7. No video, flash or other material made available on or through eFS may be downloaded, copied, saved, duplicated, stored, archived, held and or used in any way other than as intended directly for and by eFS. To do so is a breach of copyright, for which action will be taken.
  8. Other than temporary trial accounts, access to eFS resources is only through appropriately paid-for formats as intended by eFS. To do otherwise, in any way, is an infringement of our rights.
  9. eFS provides resources for other organisations to use, it does not provide resources for private individuals. As such, eFS is a "business to business" and not a "business to consumer" provider of services.
  10. Use of eFS training courses (resources) is by having purchased, in advance, access to the relevant Subscriber Login.
  11. One Subscriber Login means authorised account setup for one individual named Subscriber to use one training module, course or learning path, once only, for the stated Subscription Period.
  12. A Subscriber may navigate, pause, restart or go back in any course they are working through at any time after it has been started within the Subscription Period.
  13. The Subscription Period will be stated in the module, course or learning path specification at time of purchase.
  14. No one may use downloaded or printed training materials made available in eFS modules, courses or learning paths without having paid for a Subscriber Login.
  15. An organisation may purchase as few or as many Subscriber Logins in advance as they choose, according their own needs.
  16. Payment should be made online via an approved debit or credit card for single user Subscriber Logins.
  17. Where more than one Subscriber Login is required, then payment may be made by company purchase order by arrangement. Subscriber Login details will not be issued by Us until payment has cleared.
  18. Accepting these Terms and Conditions means You accept that no refund, credit or similar paid-for Subscriber Logins will be made by or on behalf of eFS for any reason whatsoever after payment has been authorised electronically, or cleared if not paid electronically.
  19. You accept that eFS is not liable for unauthorised access to, use or misuse of, or loss of Subscriber Login details. The Subscriber is wholly and entirely responsible for protecting access to and managing the use of their Subscriber Login details.
  20. You acknowledge that eFS is an online provider of resources and that You are responsible for ensuring users are suitably able, supported, supervised or similar, as appropriate, to use online learning, including computer literacy issues. eFS is in no way responsible for any matters arising from lack of access due to computer related issues.
  21. You accept that while you have an active account, eFS and related organisations may send unsolicited e-mail to e-mails contained within that account so long as they pertain to relevant related activities as determined by eFS.
  22. We reserve the right to make any changes in specification of the Goods which are required to conform with any applicable safety or other statutory requirements or which do not materially affect their quality or performance.

  24. eFS certificates issued by Us by e-mail are done so in accordance with a record of completed module lessons. eFS provides no guarantee that the Subscriber understands the subject, and You agree that this is a matter for others to assess and manage appropriately.
  25. IChemE certificates are only issued by e-mail when the Subscriber has passed the competence tests as judged by eFS for the subject module. eFS provides no guarantee that the Subscriber understands the subject, and You agree that this is a matter for others to assess and manage appropriately.
  26. In accepting these Terms and Conditions, you agree to be bound by them.
  27. No alterations to these Terms and Conditions may be made without the written authority of a Director of FIABLE Limited.
  28. The Contract shall be governed by the Laws of England and subject to the jurisdiction of the English Courts.
